SOCIAL MEDIA INFLUENCER CONTEST
OFFICIAL RULES
ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID OUTSIDE OF THE TERRITORY LISTED BELOW AND WHERE PROHIBITED BY LAW. INTERNET ACCESS IS NECESSARY TO PARTICIPATE. STANDARD DATA AND INTERNET ACCESS RATsnaES MAY APPLY.
Participation in the Contest by an entrant (each, an "Entrant") indicates such Entrant's full and unconditional understanding of, agreement to and acceptance of these official rules (the "Rules"). THIS CONTEST IS NOT ENDORSED BY INSTAGRAM, TWITTER, FACEBOOK OR ANY OTHER PLATFORM.
ELIGIBILITY: The Contest is open to attendees of the 2019 Pac-12 Sustainability Conference, age 18 or older at the time of entry. Employees, officers and representatives of the Pac-12 Conference ("Pac-12"), any vendors or contractors of the Pac-12 Sustainability Conference, and their respective members, subsidiaries, affiliates, advertising and promotion agencies (collectively, the "Released Parties), and their immediate family members are not eligible to enter. Void where prohibited by law.
ENTRY PERIOD: The PAC-12 SUSTAINABILITY CONFERENCE SOCIAL MEDIA INFLUENCER CONTEST (the "Contest) begins at 12:00 a.m., Pacific Time ("PT") on June 10, 2019 and ends at 5:00 p.m. PT on June 26, 2019 ("Contest Period").
HOW TO ENTER: During the Contest Period, eligible participants may participate by the following method (each an "Entry"):
Entries must be received within the Contest Period to be eligible. Entrants are subject to all notices posted online including but not limited to the Pac-12's use and privacy policies.
PRIZES/APPROXIMATE RETAIL VALUE ("ARV")/ODDS:
GRAND PRIZE: One (1) grand prize winner ("Grand Prize Winner") will receive a trip to the 2020 Pac-12 Team Green Sustainability Conference scheduled to take place in Salt Lake City, Utah (the "Grand Prize"). The Grand Prize consists of:
Approximate Retail Value ("ARV") of the Grand Prize is $1,400.00 USD.
Odds of winning will depend upon the total number of eligible Entries received. Except for the specific prizes contained within the Grand Prize, all costs or expenses related to receipt, acceptance or use of the Prizes are the responsibility Winners and are not included in the Prize. Grand Prize Winner may be referred to collectively as "Winner" in these Rules. All details with respect to the Grand Prize, including airline, flight times, lodging locations, and dates, will be determined by the Pac-12 in its sole discretion.
DETERMINATION OF WINNER:
The Grand Prize Winner(s) will be selected on or about June 26, 2019, from among all eligible Entries received during the Contest Period by the Pac-12 (or its designated administrator) whose decisions are final.
All Winner determinations will be conducted by Pac-12 or its Administrator whose decisions are final and binding in all matters relating to this Contest.
PRIZE CONDITIONS: Winners assume all risk and liability for any injury or damage caused or claimed to be caused by or to Winner, by or to Winner's guests, if applicable, or the use/misuse or redemption of any Prize by Winner or Winner's guests.
By accepting a Prize, Winners agree to release the Released Parties from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the Contest or for damages of any kind caused by any Prize or resulting from acceptance, possession, or use/misuse of any Prize awarded.
All local, state and federal taxes are solely the responsibility of Winner.
Grand Prize Winners will be required to complete and sign and Affidavit of Eligibility and Liability/Publicity Release form provided to them to be returned within three (3) days of written notification, or the Grand Prize may be forfeited and an alternate Winner selected. The Grand Prize Winners will also be required to disclose his/her social security number for the purpose of issuance of a 1099 Form for tax purposes. No substitution or transfer of Prize or election of cash in lieu of Prize will be permitted. The Pac-12 reserves the right at its sole discretion to substitute any or Prizes with another Prize of equal or greater value in the event that the Prize (or any component thereof) is not available. If any potential Grand Prize Winner fails to respond to the Pac-12's and/or Administrator's email notification within three (3) days of the initial contact by the Pac-12 or Administrator, then such person shall be disqualified and an alternate Winner may be awarded the applicable Prize. Further, if a Prize or Prize notification is returned as undeliverable, or if Winner is found to be ineligible or not in compliance with these Rules, such Winner will be disqualified and the Prize may be awarded to an alternate Winner in a separate random drawing.
PRIZE CONDITIONS:
All travel and other expenses related to the acceptance or use of the Prize are the sole responsibility of Winner.
In the event the Winner engages in behavior that, as determined by the Pac-12, is obnoxious, threatening, illegal; intended to annoy, abuse, threaten or harass any other person; or otherwise engages in behavior that the Pac-12 deems would reflect unfavorably on the Pac-12, the Pac-12 reserves the right to terminate the Prize in whole or in part, with no further compensation.
Grand Prize is not redeemable for cash. Prize is non-assignable or transferable. No substitution is permitted except if Prize is unavailable, in which case a Prize of equal or greater value will be awarded. No cash in lieu of Prizes or any exchange or substitution of Prizes, except at the sole discretion of the Pac-12. Any other incidental expenses on Prize not specified herein are the Winner's sole responsibility.
Prize is awarded "as is" with no warranty or guarantee, either express or implied by Pac-12. Winners acknowledge that Pac-12 and all other businesses affiliated with this Contest and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the Prize being offered, except that each merchandise Prize shall be subject to its manufacturer's standard warranty (if any).
Prizes are not redeemable for cash. Prizes are not assignable or transferable. No substitution is permitted except if Prize is unavailable, in which case a Prize of equal or greater value will be awarded. Any other incidental expenses on Prize not specified herein are the Winner's sole responsibility. Prizes will not be replaced if lost or stolen. Gift cards and vouchers, if applicable, are subject to the issuing company's complete terms and conditions, including expiration dates.
Tickets are not redeemable for cash and will not be replaced if lost or stolen. Tickets are subject to the issuing company's complete terms and conditions. In the event that the scheduled game does not take place as scheduled, for reasons such as cancellation, preemption or postponement, or for any reason beyond the control of the Pac-12, Pac-12's sole responsibility will be to award any remaining portion of the Prize and no additional substitution or compensation will be provided.
Except where prohibited by law, entry and acceptance of Prize constitute permission to use Winner's name, Prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.
GENERAL: By accepting a Prize, where permitted by law, Winner or recipient grants to the Pac-12, including its parent, subsidiaries and related companies, and those acting pursuant to the authority of Pac-12, the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time the recipient's full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification. IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS PROMOTION OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES. By participating, Entrants release and agree to hold harmless the Released Parties from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Promotion or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of the Prize(s). Winners acknowledge that Pac-12 and the Released Parties have not made, nor are they in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, with respect to the Contest or the Prize. Pac-12 is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the Prize.
USE OF DATA: By entering and providing the required entry information, Entrants acknowledge that the Pac-12 may also send information, samples or special offers it believes may be of interest to Entrant, or other information or goods offered by its marketing partners. All information collected from Entrants are subject to the Pac-12's Privacy Policy, which can be found at https://static.pac-12.com/Images/general/pdfs/privacy.pdf.
By participating in the Contest, Entrants hereby agree to Pac-12's collection and usage of their personal information and acknowledge that they have read and accepted Pac-12's Privacy Policy.
NOTICE TO ENTRANTS: In the event of a dispute over the identity of an Entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Pac-12 may ask any Entrant or potential Winner to provide Pac-12 with proof that such party is the authorized account holder associated with the entry to Pac-12's satisfaction. By participating in the Contest, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Pac-12 and the independent Administrator, which are final and binding in all matters relating to the Contest. Failure to comply with these Official Rules may result in disqualification from the Contest. Pac-12 reserves the right to: (i) permanently disqualify from any Contest it sponsors any person it believes has intentionally violated these Official Rules; and (ii) withdraw the online method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Contest), and to select Winners from among all eligible entries received prior to withdrawal.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE CONTEST, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND PAC-12 RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
DISPUTES: Except where prohibited, Entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant's rights and obligations, or the rights and obligations of the Pac-12 in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney's fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.
THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT, AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
